Capacity Assessments are required in a number of circumstances in order to ascertain a person's capacity to make a specific decision. The most common capacity assessments I am asked to perform are: Capacity Assessment for an application to the Office of Care and Protection for a Controllership Order to allow someone to take control of the finances of a person who has become mentally incapable of managing their own affairs. Assessing the capacity of a person to grant an Enduring Power of Attorney. Testamentary capacity - assessing the capacity of a person to make or alter a valid Will. Welfare capacity assessments - assessing the capacity of a person to make decisions about their own care and treatment, and to give or withhold consent. Domicile capacity assessments - assessing the capacity of a person to make decisions about where they live - in their own home or in a care facility. I am often requested to perform a capacity assessment by a family member, a social worker, or a solicitor. Since capacity assessments are decision-specific, in order to carry out the assessment I require instructions on a clear, specific decision to be assessed. Once this question has been identified I may need to request further information in advance of performing the assessment. In cases of applications for Controllership or Enduring Power of Attorney I will require instructions from a solicitor, setting out the particulars of the person's finances and assets which will form part of the decision to be assessed. The fee for capacity assessments carried out in clinic starts from £300 depending on the complexity of the decision to be assessed. Home visits for capacity assessment are also available. These are priced from £450.
